1. Introduction and Acceptance of Terms
Welcome to Life Between Ports (“we,” “us,” “our,” or “the Company”). By accessing our website (www.lifebetweenports.com), requesting our travel services, or engaging with us in any capacity, you (“Client,” “you,” or “your”) agree to be bound by these Terms and Conditions (“Terms”).
Please read these Terms carefully before using our services. If you do not agree with any part of these Terms, you must not use our services.
Life Between Ports is operated by Life Between Ports, operated by Wilhemina A Guzman, registered in the Netherlands with KVK Number 83347623 and VAT Number NL862838873B01.
2. Services Provided
Life Between Ports offers the following services:
- Travel planning and itinerary design
- Travel booking on behalf of clients (flights, accommodation, transfers, tours, cruises, and related travel products)
- Travel consulting and advisory services
- Group trip and retreat organization
- Travel content and editorial services via our blog and media channels
We act as an independent travel agent and intermediary between you and third-party travel suppliers (airlines, hotels, tour operators, cruise lines, etc.). We are not a travel supplier ourselves.
3. Agency Relationship and Limitation of Liability
3.1 Role as Travel Agent
When making bookings on your behalf, Life Between Ports acts solely as an agent for the travel suppliers providing your travel products and services. All bookings are subject to the terms and conditions of the relevant travel supplier.
3.2 Third-Party Supplier Responsibility
We are not responsible for the acts, omissions, errors, representations, warranties, or negligence of any travel supplier. This includes, but is not limited to:
- Flight delays, cancellations, or schedule changes
- Hotel overbooking or changes in accommodation quality
- Tour operator changes or cancellations
- Cruise line itinerary amendments
- Any personal injury, property damage, or loss caused by third-party suppliers
3.3 Limitation of Liability
To the maximum extent permitted by applicable Dutch and international law, Life Between Ports’s total liability to you for any claim arising out of or relating to these Terms or our services shall not exceed the total fees paid by you to Life Between Ports (excluding supplier costs) in the twelve (12) months preceding the claim.
We shall not be liable for indirect, incidental, special, consequential, or punitive damages of any nature.
4. Fees, Payment, and Commission Disclosure
4.1 Service Fees
Life Between Ports charges planning and consulting fees for our services. These fees are separate from the cost of travel products and will be communicated to you in writing prior to engagement. Fees are non-refundable once services have commenced, unless otherwise agreed in writing.
4.2 Commission Disclosure
In addition to service fees, we may receive commissions, incentive payments, or other remuneration from travel suppliers when booking travel products on your behalf. This is standard industry practice and does not affect the impartiality of our advice or the price you pay.
4.3 Payment Terms
- All fees are quoted and payable in the currency specified in your proposal or invoice
- Payment is due within the timeframe specified on your invoice
- Supplier costs (flights, hotels, etc.) are typically due at the time of booking or per supplier requirements
- We accept payment by [bank transfer / credit card / other methods as applicable]
4.4 VAT
VAT (if applicable) will be applied in accordance with Dutch tax law and EU VAT regulations. Our VAT number is NL862838873B01.
5. Bookings, Confirmations, and Changes
5.1 Booking Process
A booking is confirmed only when we issue a written confirmation and all required deposits or payments have been received. Verbal or informal agreements do not constitute confirmed bookings.
5.2 Your Responsibility to Review
You are responsible for reviewing all booking confirmations, tickets, and travel documents immediately upon receipt. Any errors must be reported to us within 24 hours of receipt. We are not liable for costs arising from errors not reported within this window.
5.3 Changes to Bookings
Requests to change confirmed bookings must be made in writing. Changes are subject to supplier availability and may incur amendment fees from the supplier as well as an additional service fee from us. We will communicate all costs before processing any change.
6. Cancellations and Refunds
6.1 Cancellation by You
If you wish to cancel a confirmed booking, you must notify us in writing. Cancellation charges vary by supplier and will be specified in your booking confirmation. Our planning and service fees are non-refundable once work has commenced.
6.2 Cancellation by Supplier
If a travel supplier cancels your booking, we will use reasonable efforts to obtain a refund or alternative arrangements on your behalf. We are not liable for any supplier cancellation but will act in your best interest as your agent.
6.3 Refund Processing
Refunds from suppliers are subject to their individual policies and timelines. We will pass refunds to you promptly upon receipt, minus any applicable fees. Refunds typically take 4–12 weeks depending on the supplier.
6.4 Travel Insurance
We strongly recommend purchasing comprehensive travel insurance to protect against cancellations, medical emergencies, and other unforeseen events. Failure to obtain travel insurance is at your own risk.
7. Client Responsibilities
You are solely responsible for:
- Ensuring you hold a valid passport with sufficient validity for all destinations (typically 6 months beyond travel dates)
- Obtaining all required visas, entry permits, and travel authorizations
- Complying with health requirements including vaccinations or health declarations
- Reviewing travel advisories issued by your home country and destination countries
- Ensuring all personal details provided to us are accurate and match your travel documents
- Arriving at airports, ports, and venues at the required times
- Ensuring you are in adequate health to undertake the proposed travel
We are not liable for any loss, cost, or inconvenience arising from your failure to meet any of the above responsibilities.
8. Travel Documents and Passport/Visa Requirements
Visa and entry requirements are the sole responsibility of the traveler. Information we provide about visa requirements is for general guidance only and may not be current. You must verify requirements with the relevant embassy or consulate. We accept no liability for denied entry or deportation.
9. Group Trips and Retreats
Where Life Between Ports organizes group trips or retreats, the following additional terms apply:
- Minimum group sizes may apply. We reserve the right to cancel a group trip if minimum numbers are not met, with a full refund of fees paid to us.
- Group pricing is subject to all members completing payment by the specified deadline.
- Individual behavior that disrupts the group experience may result in removal from the trip at your cost.
- Group itineraries are subject to change at our reasonable discretion due to unforeseen circumstances.
- Travel insurance is mandatory for all group trip participants.
10. Intellectual Property and Content
All content on http://www.lifebetweenports.com — including blog posts, itineraries, guides, photographs, videos, and graphics — is the intellectual property of Life Between Ports unless otherwise stated. You may not reproduce, distribute, or use our content without prior written permission.
Itineraries and travel plans created for you are for your personal use only and may not be shared commercially or sold to third parties.
11. Privacy and Data Protection
Your privacy is important to us. Our collection and use of your personal data is governed by our Privacy Policy, available at http://www.lifebetweenports.com/privacy-policy.
We comply with the EU General Data Protection Regulation (GDPR) and the Dutch Implementation Act (Uitvoeringswet AVG). As a data controller, we process your personal data only as necessary to provide our services, fulfill legal obligations, and with your consent where required.
We may share your personal data with travel suppliers as necessary to complete your booking. We do not sell your personal data to third parties.
12. Additional Provisions for U.S. Clients
12.1 CCPA / CPRA (California Residents)
If you are a California resident, you have rights under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA), including the right to know, delete, correct, and opt out of the sale or sharing of your personal information. To exercise these rights, please visit our Privacy Policy or contact us directly.
12.2 No Guarantee of Supplier Performance
Under U.S. law, we confirm that we are acting as a disclosed agent for travel suppliers. We make no guarantee of supplier performance and are not a co-venturer with any supplier.
12.3 Seller of Travel Registrations
Life Between Ports operates as an independent contractor under Waves and Wonder Travel LLC(for US & Canada Clients), a registered Seller of Travel in all applicable U.S. states including California, Florida, Hawaii, Iowa, and Washington. Seller of Travel registration details are held by Waves and Wonder Travel LLC. Please contact us if you require this information.
13. Governing Law and Dispute Resolution
13.1 Governing Law
These Terms are governed by the laws of the Netherlands. For EU-based clients, mandatory consumer protection laws of your country of residence shall also apply where they provide greater protection.
13.2 Dispute Resolution
We encourage you to contact us first to resolve any dispute informally. If a dispute cannot be resolved informally, it shall be submitted to the competent court in the Netherlands, without prejudice to your rights as a consumer under EU law.
13.3 EU Online Dispute Resolution
As required by EU regulations, EU consumers may use the European Commission’s Online Dispute Resolution (ODR) platform at: https://ec.europa.eu/consumers/odr
14. Force Majeure
We shall not be liable for any failure or delay in performing our obligations caused by events beyond our reasonable control, including but not limited to natural disasters, pandemics, acts of government, war, terrorism, civil unrest, strikes, or extreme weather events.
In such events, we will use reasonable efforts to rebook or obtain refunds on your behalf and will communicate with you promptly.
15. Changes to These Terms
We reserve the right to update these Terms at any time. Changes will be posted on http://www.lifebetweenports.com/terms-and-conditions with an updated date. Your continued use of our services after any change constitutes acceptance of the revised Terms.
